Talk with a lawyer
You have a right to have a lawyer represent you in any criminal matter, and you have a right to court-appointed counsel if you cannot afford to hire a lawyer. You should consult with your attorney before deciding whether you are interested in DAC. Because we cannot speak with you without your attorney's permission, if you are represented, your attorney must apply on your behalf and we cannot accept applications directly from you.

After application
Your application will be reviewed by the District Attorney, and you will be assessed by DAC staff. Before admission, you will be brought before the judge to make sure you understand the requirements of DAC. We strive to process every application so that release from custody and entry into treatment takes no more than 30 days. |
To be eligible for participation, you must be at least 18 years of age, a U.S. citizen or legal resident, and a resident of Cherokee County. You must have a current felony drug charge or drug-related charge, or a pending probation revocation related to drug use. You ARE NOT eligible for admission if you have current charges or prior convictions of drug trafficking, a serious violent felony, or sex offense (as defined in Georgia law). If you have charges pending in other jurisdictions, you are not excluded from DAC and should apply if interested. However, you may need to resolve them prior to entry into DAC.
